TERMS AND CONDITIONS OF SERVICE
These Terms and Conditions of Service govern your purchases and use of products and services available through the West Indies Online (WIOL) site. The West Indies Online (WIOL) site is operated by West Indies Online and/or its subsidiaries and affiliates.
By establishing purchasing or using products or services through the West Indies Online (WIOL) site, you acknowledge and agree as follows:
GENERAL
These Terms of Service have been executed and delivered by you and constitute a valid and binding agreement between you and West Indies Online (WIOL), enforceable against you in accordance with their terms.
You shall purchase and use the products and services available through the West Indies Online (WIOL) site, in strict compliance with these Terms of Service and all applicable laws, rules and regulations. All calls, emails and other communications between you and West Indies Online (WIOL) may be recorded.
ORDER PROCESSING
West Indies Online (WIOL) may, in its sole discretion, choose to not process or to cancel your reservation in certain circumstances. This may occur, for example, when the booking you wish to reserve is no longer available or has been mispriced, we suspect the reservation request is fraudulent, or in other circumstances West Indies Online (WIOL) deems appropriate in its sole discretion. West Indies Online (WIOL) also reserves the right, in its sole discretion, to take steps to verify your identity to process your reservation. West Indies Online (WIOL) will either not charge you or refund the Charges for reservations that we cancel or do not process.
All requests will be handled in the order received 24 hours a day, 7 days a week. Typically, your confirmation should only take a few hours. However there can be delays. While we ask for 24 hours, it usually doesn't take that long. If you cannot wait and need immediate confirmation, then do not make a reservation on our website.
A reservation or change of reservation is not guaranteed until you receive confirmation from us.
PRODUCT AND SERVICE AVAILABILITY
In rare cases, a hotel, trip or event may be available when a customer places the order, but becomes unavailable prior to check-in. If this should occur, your sole remedy shall be to contact West Indies Online (WIOL) to make alternative arrangements or to cancel your reservation.
PRODUCT AND SERVICE DESCRIPTIONS
West Indies Online (WIOL) attempts to provide accurate descriptions of products and services on the West Indies Online (WIOL) site. West Indies Online (WIOL) does not warrant, however, that the descriptions are accurate, complete, reliable, current or error-free.
Hotel ratings displayed on the website are intended only as general guidelines and West Indies Online (WIOL) do not guarantee the accuracy of the ratings.
DISPUTES
wiol.com/ West Indies Onlineis committed to customer satisfaction, so if you have a problem or dispute, we will try to resolve your concerns.
You agree to give us an opportunity to resolve any disputes or claims relating in any way to the Website, any dealings with our customer service agents, any services or products provided, any representations made by us by contacting wiol.com Customer Support or contact@wiol.com. If we are not able to resolve your Claims within 30 days, you may seek relief through arbitration.
RESERVATION CANCELLATION
Each hotel has its own terms and conditions for cancelling confirmed reservations. These terms and conditions are displayed on our website and you are strongly advised to read them carefully before making your reservation. You will be bound by such terms and conditions. In the event of cancellation, we ask you to contact us directly and promptly in order to minimise any possible penalty or charges payable.
In all instances, the customer must obtain a cancellation confirmation number from West Indies Online (WIOL). If a cancellation confirmation number is not issued by us, the reservation will be considered as not having been cancelled.
CHANGES IN RESERVATION
Changes during the penalty period are considered as a cancellation and rebooking.
NO SHOW
In order to avoid a penalty, as per the No Show Policy, a cancellation must be made no later than 3 p.m. on the day before arrival.
TAXES AND FEES
The sales or other taxes charged in connection with your booking depend on the location of the event, property or service provider, any rules governing those service providers, or other requirements. Service providers may also charge service fees. You will be able to view the taxes and additional service fees included in a booking before confirming the booking.
INCIDENTALS
West Indies Online (WIOL) bookings do not include any incidental charges, expenses or services, except as specifically described in the sales description. You are liable for any such incidental charges, expenses or services that you incur or consume during your trip.
PAYMENT
All reservations booked through West Indies Online (WIOL) must be prepaid in full. You agree to pay to West Indies Online (WIOL) the fees, costs, expenses and other charges in connection with your reservation. You acknowledge and agree that the Charges will be billed to your payment card, or that you will pay the Charges using another payment method approved by West Indies Online (WIOL).
TRAVEL DESTINATIONS
Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. We urge you to review travel prohibitions, warnings, announcements and advisories issued by all relevant governmental authorities and agencies prior to booking travel to international destinations.
INSURANCE
Given the nature of travel services, we recommend that you obtain independent insurance to provide adequate cover for medical expenses, personal accident, loss of baggage and curtailment or cancellation of your trip. Please note that such insurance is not included with your purchase on West Indies Online (WIOL).
MODIFICATION OF TERMS OF SERVICE
You acknowledge and agree that West Indies Online (WIOL) may, in its sole discretion, modify, add or remove any portion of these Terms of Service at any time and in any manner, by posting revised Terms of Service on the Site. You may not amend or modify these Terms of Service under any circumstances. The current version of these Terms of Service is available at [https://www.wiol.com/terms.php]. It is your responsibility to check periodically for any changes we make to the Terms of Service. Your continued use of this Site after any changes to the Terms of Service means you accept the changes.
APPLICABLE LAW
The contents of our website and of all reservations made using Our Services shall be governed by the laws of France, as well as these terms and service and any dispute, controversy, proceedings or claim of whatever nature in relation thereto. In case of litigation concerning the validity, interpretation or execution of all or part of these Terms and Service, the French courts shall have sole jurisdiction.
